Several respected organizations have analyzed Israel’s military campaign in Gaza, concluding it meets the legal criteria for genocide under the 1948 Genocide Convention, which requires acts like killing or inflicting destructive conditions with intent to destroy a group in whole or in part. These reports often cite over 58,000 Palestinian deaths (mostly civilians), widespread displacement, and statements by Israeli officials as evidence of intent. However, Israel and the USA reject these claims.

Legal and Humanitarian Context

The International Court of Justice (ICJ) has issued provisional measures in the South Africa v. Israel case, ordering Israel to prevent genocide, but has not yet ruled on the merits. UN experts and rights groups emphasize violations of international humanitarian law, including the use of starvation as a weapon. Critics, such as the American Jewish Committee, argue that applying “genocide” dilutes the term, pointing to Israel’s aid efforts and warnings to civilians as counter-evidence.

Detailed Timeline and Context

The declarations emerged amid escalating violence since October 2023, with reports building on earlier UN warnings. Key triggers include Israel’s blockade, airstrikes destroying 90% of Gaza’s schools (per UN data), and restrictions leading to famine-like conditions affecting 93% of the population. International responses include ICJ provisional measures (January-May 2024) and ICC warrants (November 2024) for Israeli leaders on war crimes, though not explicitly genocide. Organizations’ analyses often reference Article II of the Genocide Convention: killing members of the group, causing serious harm, and inflicting destructive living conditions.
